The leasehold enfranchisement legislation gives rights to almost all owners of leasehold flats and houses to acquire either a 90 year lease extension, to be aggregated to the present lease, or exercise freehold purchase. Together with your solicitor, I can guide you through the leasehold enfranchisement/freehold purchase process.
If you live in a block of flats or a converted house, you may not be happy with your managing agent/freeholder. You may choose to opt for a lease extension or collective freehold purchase, subject to the requisite number of leaseholders participating in the freehold purchase, thus giving the tenants control of the building.
It is very important to exercise freehold purchase or lease extension prior to the lease reducing below 80 years; the costs are greatly reduced.
Leasehold enfranchisement ie. purchase freehold or lease extension is not unduly complicated but it can add substantially to the value of your property. Since 1977, I have acted for many tenants, initially regarding freehold purchase of small houses because the legislation was limited only to small houses from 1967. However, since 1993, when the legislation extended to include flats, I have been involved on a daily basis with lease extensions and freehold purchases.
